Terms and Conditions of Service

LikeMynds provides its service ("Service") to you, subject to the following Terms and Conditions of Service ("TCOS"), which may be updated at any time without notice to you. You should review the TCOS periodically for changes at http://www.likemynds.com/terms.do. The Service covers all the services, features and functionality of and relating to the LikeMynds website at http://www.likemynds.com.

Our privacy policy describes the information we collect and what we do with it.

Description of Service

LikeMynds is an online service that allows users to search for other people who have registered with the service based on user specified criteria. Other related services are provided to support and enhance this such as user-to-user messaging.

LikeMynds also provides an environment for posting and reading 'Small Ads' for business advertising, individual personal items and good causes. We do not handle payments for goods advertised and exchanged through the website.

Use of Service

Your use of the Service is governed by these Terms and Conditions of Service.

LikeMynds reserves the right to modify or discontinue the Service (or any part thereof) with or without notice at any time. LikeMynds shall not be liable to you or any third party for any modification or discontinuity of the Service.

You are responsible for maintaining the confidentiality of your account password and shall immediately inform LikeMynds of any unauthorised use of your account or other security breach. You are fully responsible for all activity undertaken on your account.

Termination

You agree that LikeMynds may terminate your account and access to the Service at any time, without prior notice and for any reason. You agree that such terminations are at LikeMynds sole discretion. Without limiting the foregoing, the following will lead to termination of a user's account (a) breaches or violations of these Terms and Conditions of Service, (b) as required by law (e.g. in response to subpoenas or court order), (c) a request by you, (d) unexpected technical issues or problems, and (e) extended periods of inactivity.

Termination of your account includes (a) removal of access to all aspects of the Service, (b) forfeiting any credits and upgrades on your account, and (c) barring further use of the Service. Further, you agree that LikeMynds shall not be liable to you or any third-party for any termination of your account or access to the Service.

User Conduct

You understand and agree to not use the Service:

• for any illegal activity
• for storing or sending abusive, hateful, pornographic or otherwise objectionable information or messages
• for storing or sending information that you do not have the legal and/or contractual right to use in this manner, for example but not limited to information protected by copyright, patent or trademark
• to impersonate another person or entity
• for sending unsolicited marketing emails, advertisements, promotional material, "junk mail", "spam" or other forms of solicitation
• for storing or sending software viruses, trojans, spyware or any other software intended to disrupt the operation or limit the capability of any computer software and/or hardware or telecommunications system
• to forge headers or other information in order to disguise the origin of any information sent through or from the Service

You agree not to disrupt the normal operation of the Service. You agree not to attempt to access any information or software from the Service that is not accessible through the normal operation of the Service. You agree not to interfere with or disrupt the LikeMynds website, the servers the website runs on or any related networks, equipment and software.

You agree not to reproduce, copy, sell, rent or exploit for any commercial purposes any portion of the Service.

You agree to provide true, current, accurate and complete information when creating your account and to promptly maintain this information to keep it true, current, accurate and complete.

LikeMynds Communications

As part of the Service, LikeMynds may need to contact you via email. You agree to receive emails which relate to your account and are necessary for the normal and ongoing operation of the Service.

International Use

You agree to comply with all local laws and rules regarding online conduct, including the export of information, in your country of residence. Wherever you reside, you agree to comply with all United Kingdom laws regarding online conduct and the export of information.

Access to the Service

You agree not to disguise or simulate the appearance or function of the LikeMynds website. Furthermore, you agree not to take any action that interferes with the proper working of the website servers and associated equipment and software or places an unreasonable load on them.

You acknowledge that LikeMynds may set up and change at any time, limits on the amount of information stored by you within the Service. This includes limits on number of favourites and stored sent/received messages, limits on the number of times you may log in during a specific period, limits on the number of messages you may send as well as limits on disk and memory usage.

Age Limits

Unless otherwise stated, you must be 18 years or older to join the individual LikeMynds services (dating, small ads etc). If you are under 18 you may create an account and join and use only those services that explicitly state they are available for those under 18.

Fees

Registering for a basic LikeMynds account is free. Charges may apply for using aspects of the Service once registered, for example, when contacting other users of the Service. LikeMynds reserves the right to start charging for the Service or any part thereof that was previously free and to modify current pricing and the pricing model without prior notice.

Credits (or free-use periods) obtained through pre-registration (or other offers) may only be used in exchange for Services on the LikeMynds website and have no monetary value.

Indemnification

By accepting these TCOS, you agree to indemnify and otherwise hold harmless LikeMynds, its employees and anyone involved in the development, maintenance and support of the website from any direct, indirect, incidental, special, consequential or exemplary damages resulting from i) your use of the Service; ii) unauthorized access to or alteration of your communications with or through the Service, or iii) any other matter relating to the Service.

Disclaimer of Warranties

YOU ACKNOWLEDGE AND AGREE THAT THE SERVICE IS PROVIDED "AS IS" AND THAT LIKEMYNDS ASSUMES NO RESPONSIBILITY FOR ANY FAILURE TO STORE OR DELIVER ANY INFORMATION ENTERED BY YOU.

LIKEMYNDS MAKES NO WARRANTY THAT (i) THE SERVICE WILL MEET YOUR REQUIREMENTS, (ii) THE SERVICE WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE, (iii) THE OPERATION OR RESULTS OF THE SERVICE WILL BE ACCURATE OR RELIABLE, (iv) THE QUALITY OF THE SERVICE WILL MEET YOUR EXPECTATIONS, AND (V) ANY ERRORS IN THE SOFTWARE WILL BE CORRECTED.

SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF CERTAIN WARRANTIES OR THE LIMITATION OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES. ACCORDINGLY, SOME OF THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU.

Limitation of Liability

YOU EXPRESSLY UNDERSTAND AND AGREE THAT LIKEMYNDS SHALL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO, DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA OR OTHER INTANGIBLE LOSSES (EVEN IF LIKEMYNDS HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES).

FURTHER AND WITHOUT LIMITING THE FOREGOING, LIKEMYNDS SHALL NOT BE LIABLE FOR THE ACCIDENTAL LOSS OR DISTRIBUTION OF ANY INFORMATION YOU ENTER INTO THE SITE OR ANY CONSEQUENCE OF SUCH LOSS OR DISTRIBUTION. LIKEMYNDS SHALL NOT BE HELD LIABLE FOR ANY LOSS RESULTING FROM DEALINGS WITH MERCHANTS OR ADVERTISERS WHO APPEAR ON THE SERVICE. ANY DEALINGS WITH MERCHANTS OR ADVERTISERS ARE SOLELY BETWEEN YOU AND SUCH MERCHANT OR ADVERTISER AND ARE SUBJECT TO THEIR TERMS AND CONDITIONS AND PRIVACY POLICIES.

SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF THE LIMITATION OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES. ACCORDINGLY, SOME OF THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU. IN NO EVENT WILL LIKEMYNDS' TOTAL CUMULATIVE DAMAGES EXCEED £10.

Entire Agreement

These TCOS constitute the entire agreement between you and LikeMynds and governs your use of the Service, superceding any prior agreements between you and LikeMynds.
